Who these terms are between

Using guides.cdlscan.com means accepting these terms. If you do not accept them, please do not use the site. "We" means CDL scan, the publisher. The CDLScan product at cdlscan.com has its own terms, which govern that service.

These guides are information, not advice

The guides describe how US federal regulations — principally 49 CFR and the Fair Credit Reporting Act — apply to hiring and screening commercial drivers. That is general information about how the rules work. It is not legal advice, and reading it creates no attorney-client relationship, no consulting relationship, and no duty of care between us and you.

Your situation has facts we do not know. Before you turn anything here into a hiring policy, an adverse-action procedure or a contract clause, have it reviewed by a lawyer who knows your operation and your state.

Regulations change, and we may be behind them

We cite primary sources — ecfr.gov, fmcsa.dot.gov and ftc.gov — and check figures, thresholds and section numbers against them before publishing. Even so, rules are amended, effective dates move, and a guide accurate on the day it was written can go stale.

Verify the current text of any section before you rely on it. Where a guide gives a deadline, a threshold or a dollar figure, treat it as a pointer to the source rather than as the source.

The assistant

The assistant on this site answers from the published guides and cites which ones it used. Its answers are generated by a language model and can be wrong or incomplete, even when the underlying guide is right. Treat an answer as a way to find the relevant guide, not as the final word — and never as a substitute for reading the regulation itself.

Please do not put a driver's personal details into it. Questions are redacted before storage, as the Privacy Policy describes, but the simplest protection for a third party is not to type their information in the first place.

What this site is not a substitute for

Federal rules require carriers to run certain checks — among them the driver investigation history under 49 CFR 391.23, the annual MVR review under 391.25, and Clearinghouse queries. Nothing on this site, and nothing offered through CDLScan, removes or reduces any of those obligations. Any product we describe sits alongside the required checks, never in place of them.

Links to other sites

We link to government sources, to the CDLScan product and occasionally elsewhere. We do not control third-party sites and are not responsible for their content, accuracy or privacy practices. A link is not an endorsement, except where we say plainly that we publish or operate the thing being linked to.

Content and reuse

The text, structure and images on this site belong to us. You are welcome to read, print and circulate a guide inside your own company, and to quote a short passage with attribution and a link. Republishing a guide in full, or using this material to train a model or build a competing product, requires our written permission.

Availability

We may change, move or withdraw any guide, and the assistant may be unavailable at times. We do not promise uninterrupted service.

Liability

To the fullest extent the law allows, we are not liable for loss arising from decisions made in reliance on this site — including hiring decisions, compliance findings, or the cost of an adverse-action process. The site is provided as-is, without warranties of accuracy, completeness or fitness for a particular purpose.

Nothing here limits liability that cannot lawfully be limited.

Changes to these terms

We may update these terms; the date at the top shows when they last changed. Continuing to use the site after a change means accepting the updated terms.
